Mackean Law Firm was invited by the Ministry of Transport, through the Centre of Research and Consultations for Maritime Transportation, to provide legal services regarding the best appropriate rules proposed to govern the various activities in sea ports. Such invitation to offer consultations came in consequence to the then new Governmental approach in following the open doors policy and adopting the concept of privatization and private sector’s contribution in the economy. The critical issue as to the desired consultation related to the role of the private sector in the context of administrating and establishing public utilities. The respective concept happened to be the core idea in concessions. Both public utilities’ necessities and assigning their management to other than the Government it self or a Governmental agent should have then been considered.
